This Service Agreement (hereinafter – the “Agreement”) is entered into between:
Service Provider: FOP Voloshyna Yegine Seyranivna (Dogchill), acting on the basis of the entry in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations No. 2 065 000 0000 043491 dated 23.08.2016.Client: An adult, legally capable individual (aged 18 or older) who has accessed the Website, placed an Order, and uses the Services in accordance with this Agreement.
DEFINITIONSIn this Agreement, unless the context otherwise requires, the following terms shall have the meanings set out below:“Website” or “Site” means the website available at http://dogchill.com.ua (including all subdomains), as well as all profiles, orders, agreements, forms, and other materials linked from the Site.“Client” means an adult, legally capable individual (aged 18+) who has accessed the Site and uses the Services.“Dogchill” or “Service Provider” means FOP Voloshyna Yegine Seyranivna, operating under the above registration.“Services” means the pet care services listed on the Website (dog walking, boarding/dogsitting, hourly nanny/sitting services), provided by Dogchill through engagement of third parties.“Pet Profile” or “Questionnaire” means the form attached to this Agreement, available on the Site, which the Client must complete before the commencement of the ordered Services.“Offer” means the Client’s proposal to conclude this Agreement remotely via the Site (by completing the relevant form, Pet Profile, or order), by telephone, or by sending a message via messenger to the number indicated on the Site.“Order” means a properly completed and submitted Offer by the Client addressed to Dogchill, evidencing the Client’s intention to be bound by this Agreement. The Order becomes available to Dogchill upon receipt via the Site or other agreed method.“Acceptance of the Order” means Dogchill’s confirmation of acceptance of the Order sent to the Client’s email or messenger, or any other action by Dogchill indicating acceptance (e.g., issuance of an invoice). Upon Acceptance, this Agreement is deemed concluded between the parties on the terms set out in the Order and this Agreement.“Subscription” or “Prepaid Package” means a volume of Services, information about which is published on the Site, that Dogchill undertakes to provide to the Client within one (1) year from the date of 100% prepayment, upon the Client’s request.
1. GENERAL PROVISIONS1.1. This Agreement is not a public contract within the meaning of Article 633 of the Civil Code of Ukraine. The text of this Agreement and other information on the Site do not constitute an offer (proposal) by Dogchill but rather an invitation for the Client to submit an Offer to conclude this Agreement on the terms set out in the Order and the rules published on the Site.1.2. By placing an Order in accordance with the Site’s Terms of Use (via the website form, messenger, or telephone), the Client confirms acceptance of all terms of this Agreement, the conditions specified during placement of the Order, and all other rules published on the Site. The Agreement shall be deemed concluded between the Client and Dogchill only upon Acceptance of the Order by Dogchill.
2. SUBJECT OF THE AGREEMENT2.1. Under this Agreement, Dogchill undertakes, upon the Client’s Order, to provide the Services specified in the Order, and the Client undertakes to pay for such Services.2.2. At the Client’s request, Dogchill shall provide the Services in accordance with the Order, the terms of this Agreement and its appendices, as well as other rules and conditions published on the Site.
3. RIGHTS AND OBLIGATIONS OF THE PARTIES3.1. Dogchill undertakes to:3.1.1. Commence provision of the Services on the date and at the time specified in the Order as the start date/time;3.1.2. Provide all Services listed in the Order in full and with due quality by the completion date specified in the Order (Dogchill reserves the right to reasonably extend the completion date unilaterally in case the actual volume or complexity of Services significantly exceeds average statistical indicators);3.1.3. Upon completion of the Services, notify the Client by sending a corresponding message and service report via the messenger (Telegram) to the telephone number provided by the Client during placement of the Order or completion of the Pet Profile.
3.2. Dogchill has the right to:3.2.1. Independently determine the methods of performing the Client’s task;3.2.2. Engage third parties to provide the ordered Services. The Client agrees that Dogchill may, at its sole discretion, assign performance to any third party under a separate agreement between Dogchill and such party. The Client may not require that Services be performed by any specific individual or by Dogchill personally;3.2.3. Unilaterally refuse to perform this Agreement at its own discretion. In such case, Dogchill shall refund to the Client all previously paid amounts except for Services already actually rendered. In the event of the Client’s breach of obligations under clauses 3.3.2–3.3.8, Dogchill may retain the amounts paid as compensation.
3.3. The Client undertakes to:3.3.1. Not request Services that are not expressly listed on the Site or in the relevant Order;3.3.2. Provide accurate information about the dog, cat, or other domestic animal using the Pet Profile form (which forms an integral part of this Agreement) and ensure safe conditions for Dogchill to provide the Services. In case of a safety violation caused by the Client resulting in an accident involving Dogchill or the Client, the Client shall take all necessary measures to eliminate threats to life and health and provide first aid, and shall bear responsibility in accordance with the applicable laws of Ukraine;3.3.3. Provide Dogchill with all necessary materials and medications if the animal requires veterinary care or previously known procedures, and supply all necessary and sufficient information for such procedures and treatment;3.3.4. Provide Dogchill with food and water for the animal in accordance with normal dietary standards;3.3.5. Treat Dogchill with respect and refrain from any form of insult to human dignity, physical or psychological violence, or personal insult;3.3.6. Pay for the Services in full in accordance with the Order;3.3.7. Collect the dog, cat, or other domestic animal from Dogchill upon expiry of the service period. If the Client fails to accept or collect the animal within ten (10) days after the end of the service period, Dogchill shall have the right to dispose of the animal at its sole discretion. The Client loses the right to demand return of the animal after the 10-day period, and Dogchill will not accept or consider any claims for return after such period. In case of violation of this clause, the Client shall pay Dogchill in full for supervision of the animal and compensate all additional losses incurred by Dogchill;3.3.8. Inform Dogchill in advance about any recording devices used during provision of the Services. If the Client fails to inform Dogchill (including hidden devices) before commencement of the Services, the Client is prohibited from making video recordings of the process of providing the Services by Dogchill or any third parties engaged by Dogchill;3.3.9. Within twelve (12) hours from the completion time specified in the Order, notify Dogchill by any means of any claims regarding the result of the Services. If no claim is received within this period, the Services shall be deemed to have been provided with due quality and accepted by the Client in full and without reservations.
3.4. The Client has the right to:monitor the progress and quality of the Services at any time and give Dogchill oral instructions regarding the provision of Services within the scope agreed by the parties at the time of conclusion of this Agreement.
3.5. Acceptance of ServicesImmediately upon completion of the Services, the Client is obliged to accept the Services (their result). If any deviations from the terms of this Agreement that impair the result, or other deficiencies, are discovered, the Client must immediately notify Dogchill. A Client who discovers deficiencies upon acceptance may only rely on them if such deficiencies were recorded in the acceptance document or other document evidencing acceptance. The cost of Services that were not provided in full or were provided in violation of this Agreement due to Dogchill’s fault shall be refunded to the Client within five (5) business days.
4. COST OF SERVICES AND PAYMENT PROCEDURE4.1. The volume and scope of Services under clause 2.2 shall be agreed by the parties in the Order and calculated on the basis of the prices published on the Site. The final price shall be agreed in the invoice issued by Dogchill.4.2. The Client undertakes to pay for the Services in full on a 100% prepayment basis. The parties agree that Dogchill may commence provision of Services before payment is received; in such case, the Client undertakes to pay within three (3) banking days from receipt of the invoice or within three (3) banking days from actual provision of the Services, whichever occurs first.4.3. Payment shall be made by bank transfer on the basis of the issued invoice or by any other method permitted under the applicable laws of Ukraine.4.4. The Client may cancel ordered Services before they commence, subject to the following notice periods:• For “Walk” and “Nanny” services – at least 2 hours before the scheduled start time.If cancellation occurs later than the specified notice period or after commencement of Services, the amounts paid for “Walk” and “Nanny” services may be retained by Dogchill as compensation in accordance with the terms set out in the appendices to this Agreement.If Services were ordered without prepayment and cancellation occurs later than the specified notice period or after commencement, the Client shall pay Dogchill compensation equal to the cost of the ordered “Walk” and/or “Nanny” services within three (3) banking days.4.5. The Client agrees that if a Subscription (Prepaid Package) is not used in full within one (1) year, Dogchill shall have no obligation to refund the prepaid amounts.
5. LIABILITY OF THE PARTIES5.1. In case of non-performance or improper performance of this Agreement, the parties shall be liable in accordance with the applicable laws of Ukraine.5.2. The Client bears full responsibility for any damage caused by their pet to third parties, including property of the person directly providing the Services, and shall compensate such damage in full at their own expense within five (5) banking days from the date Dogchill sends a notification via Telegram to the number provided by the Client.5.3. In the event of loss or injury to the dog, cat, or other domestic animal during provision of the Services, Dogchill undertakes to take all reasonable measures to provide assistance, search for the animal, and return it to the Client. If the animal is not found within three (3) calendar days from the date of loss, the parties undertake to settle the issue of compensation by mutual agreement on an individual basis.5.4. In addition to other remedies available under Ukrainian law, if the person directly providing the Services unreasonably violates the deadlines for provision of Services, provides Services of inadequate quality, or causes damage to the Client or the Client’s property, the Client may file a complaint with Dogchill in accordance with the claims procedure for Dogchill to take appropriate measures under the agreement concluded between Dogchill and such person.5.5. The Client is obliged to provide Dogchill with all necessary equipment for walking the animal (leash, collar, muzzle – if the animal belongs to a breed that, under Ukrainian law, must be walked only with a muzzle – and any other means required for safe keeping and walking). If the Client fails to provide such equipment or provides it in an unsuitable condition, all liability for possible violations (including administrative fines for walking without a muzzle) shall rest with the Client. If Dogchill is held administratively liable for violation of animal keeping/walking rules resulting from the Client’s failure to provide a muzzle or other mandatory equipment, the Client undertakes to fully compensate Dogchill for the fine paid and all other expenses incurred in connection with such violation.5.6. Dogchill shall not be liable to the Client for:• harm to the animal’s health or death resulting from exacerbation of chronic or difficult-to-diagnose diseases, injuries existing at the start of Services, or injuries arising suddenly after commencement of Services, or resulting from the animal’s actions that cannot be controlled by the Service Provider (aggression, refusal to obey commands, etc.);• untimely, inadequate quality, or consequences of assistance provided to the animal by third parties to whom Dogchill was forced to turn for help (veterinarian or veterinary clinic staff);• damage caused by the dog, cat, or other domestic animal to the Client’s personal property;• harm to the animal’s health or death resulting from inaccurate or incomplete information provided by the Client in the Pet Profile or Order;• harm caused by the animal to third parties, except in cases of intentional actions by the person directly providing the Services using the animal to cause harm;• loss of or harm to the animal if it occurred as a result of following the Client’s instructions (e.g., walking without a leash or with unreliable, damaged, or unsuitable equipment provided by the Client; or walking without a muzzle when the animal shows aggression toward other animals, people, or objects, leading to a conflict or dangerous situation).5.7. Dogchill’s liability is limited exclusively to direct, documented damage to the Client’s property caused during provision of the Services, if such damage is a direct consequence of Dogchill’s intentional actions, properly proven in accordance with the procedure established by law. Dogchill shall not be liable for indirect losses, lost profits, moral damages, or other consequential losses of the Client.5.8. The burden of proving the fact of damage, its nature and amount, and the causal link between Dogchill’s actions/omissions and the claimed damage lies with the Client. Any claims for compensation must be supported by proper and admissible evidence in accordance with the requirements of Ukrainian law.5.9. Upon discovering damage to or loss of property or other circumstances, the Client is obliged to notify Dogchill immediately (within three (3) hours) and provide available photo/video evidence of the damage as well as documents or other proof of the value of the property. Failure to notify or late notification may be grounds for refusal of the claim if it prevented establishment of the actual circumstances or the amount of damage.5.10. Upon receipt of a notification of possible damage or loss, Dogchill has the right to clarify the circumstances and, if necessary, request additional explanations or supporting materials from the Client. If Dogchill’s liability is confirmed, compensation shall be paid in the amount of actually incurred and documented losses, but not exceeding UAH 20,000.00 (twenty thousand hryvnias) per incident.5.11. Claims regarding loss, disappearance, or possible theft of property may be considered only if there is proper evidence that the event occurred due to Dogchill’s fault during provision of the Services. The mere fact of absence of property after provision of Services is not in itself an unconditional basis for imposing liability on Dogchill.5.12. Dogchill shall not be liable for:• damage caused by actions of an animal whose characteristics the Client failed to disclose;• natural wear and tear or hidden defects of property;• items left in open or unsecured access;• damage not supported by proper evidence.5.13. If, within twenty-four (24) hours after completion of the Services, the Client has not submitted written comments regarding the condition of the property or quality of the Services, the Services shall be deemed to have been provided properly and accepted by the Client without reservations.
6. CLAIMS PROCEDURE AND DISPUTE RESOLUTION6.1. All disputes arising out of or in connection with this Agreement shall be resolved in accordance with the applicable laws of Ukraine.6.2. In the event of any disputes, claims, or complaints regarding matters provided for in this Agreement or in connection therewith, the parties undertake to take all reasonable measures to settle them through negotiations. Compliance with the pre-trial (claims) procedure is mandatory. If a dispute, claim, or complaint is not resolved through negotiations within thirty (30) calendar days from the date the claim was sent, either party may apply to the court.6.3. Claims regarding the fact, quality, and timing of provision of Services shall be sent by the Client via email. Such claims must be sent within twelve (12) hours from the completion time specified in the relevant Order and must contain a list of deficiencies in the Services (or their result) and/or violations committed by Dogchill, a description of the damage caused to the Client, and photographs confirming the listed deficiencies and damage. Failure to submit a claim in the manner and within the time limit specified above means that the Services were provided by Dogchill in a timely manner, in full, and with due quality. A Client who misses the above deadline for submitting claims loses the right to submit claims regarding the fact, quality, and timing of provision of the Services.6.4. Claims received from Clients shall be reviewed by Dogchill within three (3) business days.
7. ENTRY INTO FORCE AND AMENDMENT OF THE AGREEMENT7.1. The text of this Agreement is permanently available on the Internet at http://dogchill.com.ua/legal.7.2. Upon proper Acceptance of the Order in the manner described above, this Agreement between Dogchill and the Client shall be deemed concluded and shall remain in force until the parties have fulfilled their obligations, unless it was terminated earlier.7.3. If Dogchill publishes a revised text of this Agreement on the Site at http://dogchill.com.ua/legal, the Agreement between the Client and Dogchill shall be deemed concluded on the terms that were in effect at the time the Client placed the relevant Order.
8. APPENDICES TO THE AGREEMENT8.1. The following documents form an integral part of this Agreement:8.1.1. List of Services and their prices (Appendix);8.1.2. The Client’s Order;8.1.3. The Pet Profile (Questionnaire) completed by the Client on the Site.

I. WALKING SERVICE (“Walk”)The “Walk” service consists of a walk with the dog in the yard. If the Client cancels before the start of the service, the amount for one day of dogsitting is non-refundable and may be retained by Dogchill as compensation. If cancelled after commencement, Dogchill refunds prepaid amounts for unused days minus compensation for one day of dogsitting. The first and last day are calculated depending on check-in/check-out time and number of walks (full day, half day, or night only – UAH 300). If dogsitting ends earlier or starts later than paid, the balance is non-refundable and may be retained as compensation. In the absence or breakdown of an elevator above the 5th floor, an individual surcharge may apply depending on floor and need to carry the dog.8) Sitting for 1 cat or other domestic pet – from UAH 900 per day.
ADDITIONAL PAID SERVICES FOR CAT SITTING:• Food preparation — UAH 100• Kitten (under 9 months or any age that misses the litter box) — UAH 300 (+ compensation for furniture/textile dry cleaning if soiled)• Non-absence (minimum possible time up to 4 hours) — UAH 350 (in cities without service – surcharge applies)• Each additional cat or other domestic animal (except dog) — UAH 300• Early check-in before 07:00 or late check-out after 21:30 — UAH 200 (if at Client’s – taxi compensation extra)III. HOURLY NANNY / NANNY SERVICE (“Nanny”)The Nanny service is an hourly pet care service. Nanny starting before 07:30 and ending after 21:30 is subject to taxi agreement. Cancellation less than 24 hours before start is charged as 1 full visit regardless of number of visits agreed. In case of power outages or non-working elevator, floor-based surcharge applies as in the Walk section. Ferrets, rabbits, lizards, turtles, guinea pigs and other domestic animals (except dogs) are charged at cat Nanny rates.— End of Agreement —Edition: 11 May 2026
